Last Will and Testament of Mary (Logwood) Lockett; wife of Richard Lockett

"In the Name of god Amen, I Mary Lockett being in a low state of helth but a sound mind, I do hearby make my last will and Testament, but first give my Soul to god that gave it and my Body to Return to the Dust from whence it was taken, till the Rise... of the same hoping he will receive the same.

I give and bequeth to my beloved Daughter Rhoda Lockett and her heirs one Sorrel mare coalt called Flie, also one bed and furniture to her and her heirs for ever.

I give and bequeth to my grand son Richard Lockett the first coalt thats raised from the coalt that I gave to his aunt Rhoda to him and his heirs for ever, and I hearby Do appoint Jeremiah Lockett and Rhoda Lockett Executors to this my last will and Testament as Witness my hand and Seal this 17th day of April one thousand Eight hundred and four. Signed Sealed and Delivered in the presents off "

Bedford County: Will Book 3, page 85

"At a Court held for Bedford County Courthouse the 22 day of July 1805.
This last Will and Testament of Mary Lockett Dec'd was probated in Court by Jeremiah Lockett the Executor there named & proved by the oaths of Nancy Lockett a subscribing wittness, and at a Court [....?.....] for said County this 23rd day of September 1805. This Will was further proved by the oath of Benjamin Kennedy an other subscribing witness & ordered to be recorded and on the Motion of Jeremiah Lockett the Ex'or who made oath, together with Thomas Logwood his Security entered into and acknowledged their Bond in the Sum of One Hundred & fifty Dollars [and obtained ?] according to Law, certifies is granted him for obtaining a motion thereof in due form, Liberty being reserved the other Executor to join in the probate when she may think fits."

Benjamin, Jr. made gifts of land and slaves to all his children during his lifetime, saying on all except Richard's deeds - "so he/she will leave my wife and myself in peace". It is apparent that his children did not care much for their step-mother.

His deed to Richard is entered in Deed Book 2, page 218, Chesterfield County, VA, dated 3 Dec 1754. He "sold" Richard 120 acres for five pounds current money.

His deed to Richard is entered in Deed Book 2, page 218, Chesterfield County, VA:
" This indenture made and concluded this third day of December in the year of Christ one thousand seven hundred fifty and four..Witnesseth that the said Benjamin Lockett for and in consideration of the sum of five pounds current money of Virginia to him in hand paid by the said Richard Lockett the receipt whereof the said Benjamin Lockett doth hereby acknowledge and himself fully satisfied therewith hath given granted sold assigned.. [several illegible words]..by these presents for himself and his heirs..[more illegible words]...unto the said Richard Lockett and to his heirs and assigns one tract or parcel of land lying in the county aforesaid containing by estimation one hundred and twenty acres and bound as follows: beginning at several markers on Henry Clay's corner to Benjamin Lockett's tobacco houses thence a straight course to a corner gum thence to go on due south to Dry Creek thence up the said creek to William Lockett's line thence up Lockett's line to Clay's line and down that line to the first station. to have and to hold use and enjoy together with all houses, gardens, fences, woods and water courses reversions and remainders belonging to the above stated land..."

LOCKETT to LOCKETT deed, Chesterfield County Deed Bk. 11, page 376.

KNOW all men by these presents that I Benjamin LOCKETT Sr. of Chesterfield County for and in consideration of the love, good will and affection which I have and bear towards my son Richard LOCKETT of the aforesaid County and Mary LOCKETT his wife, do freely lend unto them during their natural life these four negro Slaves following. Viz. Sarah a Woman and her three children as follows Viz. Betty a girl, Cate a girl and Matt a boy to keep in their possession during their natural lives. Also I do by these presents, freely, clearly and absolutely Give and grant unto the children of the said Richard LOCKETT and Mary LOCKETT the abovementioned negroes to be equally divided among them after the death of their parents.
To have and to hold the aforesaid negroes unto the children of the said Richard LOCKETT and their heirs for thenceforth, as their proper good and right forever absolutely, without any manner of condition. I the said Benjamin LOCKETT have absolutely and of my own accord set and in further testimony In witness whereof I have hereunto set my hand and seal the fourth day of March in the year of our Lord one thousand seven hundred and eighty five
